No data protection officer has been appointed, as there is no legal requirement to do so.

Contract, pre-contractual measures (brokerage agreement) and statutory basis.

The data is retained for the duration of the contractual relationship and, after its termination, at least for as long as statutory retention periods apply or limitation periods for potential legal claims have not yet expired.

We store and process the personal data transmitted or disclosed to us only insofar as this is connected with the performance of the contract (brokerage agreement). Data is disclosed only to the minimum extent required and insofar as this is necessary for the performance of the contract, is based on a statutory basis or there is a legitimate interest on the part of (third) parties involved in the transaction. Possible recipients may include: departments of the company involved in the handling of the transaction (e.g. IT, other administrative units) or companies of the corporate group (e.g. for the handling of joint projects). Third parties involved in the transaction (persons necessarily participating in the transaction and potential contracting parties, other agents, brokerage platforms, property management companies, finance providers, private and public bodies that can disclose or require information on properties, insurers). Service providers of the controller (e.g. tax advisers, payroll accounting, lawyers) as well as authorities (social insurance, tax office, other authorities), legal representatives (in the enforcement of rights or defence against claims or in the course of official proceedings) or companies engaged as contractors in the maintenance of the IT infrastructure (software, hardware). Under no circumstances will your data be passed on for advertising or similar purposes. Our employees and our service providers are bound to confidentiality and to compliance with data protection regulations. Transfer to recipients in a third country (outside the EU) or to an international organisation is envisaged; such transfer is based on standard data protection clauses and an adequacy decision. There is no automated decision-making (profiling). The provision of the data is necessary in order for the contractual relationship to be performed properly.

Our website does not use any so-called social media plugins. The logos of the social networks Facebook and Instagram as well as Google displayed on our website merely link to the corresponding profiles of our company. If you click on one of the logos, you will be redirected to the external website of the respective social network.

This website uses Google Analytics 4, a web analytics service provided by Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland), exclusively after you have consented to the “Statistics” category in the cookie dialogue (Art. 6(1)(a) GDPR, Section 165(3) of the Austrian Telecommunications Act (TKG 2021)). Without your consent, no script is loaded from Google and no data is transmitted to Google. Google Analytics sets cookies (_ga, _ga_*; stored for up to two years) in order to attribute visits and page views pseudonymously. We use this to analyse the reach and use of the website (pages and properties viewed, source of visits, device, browser) and to improve our services on that basis; Google Analytics 4 does not store IP addresses. Processing may also take place on servers of Google LLC in the USA; Google is certified under the EU-US Data Privacy Framework, and Google’s standard contractual clauses and data processing terms apply in addition. Further information is available in Google’s privacy policy (policies.google.com/privacy). For its operation, your browser additionally stores the following only locally on your device (Local Storage or Session Storage, without any transmission to us or to third parties): your decision in the cookie dialogue, your saved properties, and display states such as the scroll position when navigating back and the playback position of the video on the home page. The “Marketing” category of the cookie dialogue is not currently in use; any such services would be loaded only after your consent and would be described at this point. You can change or withdraw your selection at any time via the “Cookie settings” button at the bottom left; upon withdrawal, Google Analytics is switched off and the associated cookies are deleted. Legal basis: Section 165(3) TKG 2021 (technically necessary) or your consent (Art. 6(1)(a) GDPR).

When you access the website, our web server processes technically necessary access data (IP address, date and time, page accessed, volume of data transferred, browser and operating system, previously visited page). This data serves the operational security of the website, error analysis and the defence against attacks; it is not merged with other data sources and is stored only for as long as is necessary for these purposes. The legal basis is our legitimate interest in the secure operation of the website (Art. 6(1)(f) GDPR).

If you contact us via a form (contact, sell, investment, viewing request), we process the data you provide (name, email address, telephone number, message and, where applicable, the property concerned and details of your own property) in order to handle your enquiry and for any follow-up questions. The legal basis is the initiation of a contract (Art. 6(1)(b) GDPR) or our legitimate interest in responding to your enquiry (Art. 6(1)(f) GDPR). Delivery to our office takes place by email via the dispatch service provider Resend (Resend, Inc., USA); the transfer is based on standard contractual clauses. Viewing requests for properties are additionally created directly in our estate agency software Justimmo (Justimmo Software GmbH, Vienna) as a contact for the property concerned, so that the responsible agent can process your enquiry promptly. If you activate the newsletter in the contact form, we use your email address on the basis of your consent (Art. 6(1)(a) GDPR) to send you information about new properties and offers; you may withdraw this consent at any time. To protect against misuse, we limit the number of enquiries per IP address; for this purpose the IP address is held only briefly in memory and is not stored permanently. Your data remains stored until your enquiry has been dealt with and no statutory retention periods stand in the way.

We obtain the details and images of our properties from our estate agency software Justimmo (Justimmo Software GmbH, Vienna). Property images are loaded from Justimmo's servers (storage.justimmo.at) when a property page is accessed; for technical reasons your IP address is transmitted to Justimmo in the process. The legal basis is our legitimate interest in presenting our property portfolio (Art. 6(1)(f) GDPR).

To show property locations we use map tiles from the OpenStreetMap Foundation (St John’s Innovation Centre, Cowley Road, Cambridge CB4 0WS, United Kingdom). When a map is displayed – in the map view of the search or on a property page – your IP address and the map section displayed are transmitted to the OpenStreetMap servers. An adequacy decision of the European Commission is in place for the United Kingdom. As a matter of principle, we show the location of properties only as an approximate area, never as an exact address. The legal basis is our legitimate interest in an illustrative presentation of property locations (Art. 6(1)(f) GDPR).

For some properties we offer virtual tours from the provider Matterport, Inc. (352 East Java Drive, Sunnyvale, CA 94089, USA). The tour is embedded in the page only after you click “Start 3D tour”; only then are your IP address and usage data transmitted to Matterport. The transfer to the USA is based on standard contractual clauses. The legal basis is your consent, which you give by starting the tour (Art. 6(1)(a) GDPR).

Fonts and the video on the home page are served from our own server; neither Google Fonts nor video platforms are embedded. Links to our profiles on Instagram, LinkedIn, Facebook and YouTube lead to the respective platform, where that platform's privacy policy applies.

As a data subject, you are in principle entitled to the rights of access, rectification, erasure, restriction of processing, objection and data portability within the scope of the statutory provisions.
